BOROUGH OF HASBROUCK HEIGHTS

M I N U T E S

June 12, 2001

A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on June 12, 2001 at 8 p.m. at the Masonic Hall, 200 Division Avenue, corner of the Boulevard, Hasbrouck Heights, New Jersey.

Mayor Torre stated that the meeting complied with the Sunshine Law, due notice having been made to all members by personal service on January 1, 2001 and to The Observer, The Record and the Herald News on January 1, 2001.


ROLL CALL:

Present: Mayor William J. Torre, Councilman Andrew Link III, Councilman Herbert D. Heeren, Councilman Justin A. DiPisa, Councilman Garrett R. Pepe, Councilwoman Marlene Verrastro, Councilman John Wassberg

Absent: None

 

SALUTE TO THE FLAG AND PLEDGE OF ALLEGIANCE: Mayor Torre led in the Salute to the Flag and Pledge of Allegiance.

COMMUNICATIONS:

The following correspondence was received:

1. State of New Jersey Department of Environmental Protection regarding a Clean Water Needs Survey - This has been completed and returned.

2. State of New Jersey Department of the Treasury Division of Contract Compliance and Equal Employment Opportunity Public Contracts regarding a Public Agency Review. The representative was scheduled for today, but called and rescheduled for July 12.

3. County of Bergen Community Development regarding 2001 Community Development Block Grant funds for the Construction of a Senior Center in the amount of $61,774.00. The contract has been received and execution is scheduled for July.

4. Assemblywoman Rose Heck regarding a meeting with the Department of Transportation Commissioner regarding a new line of transportation in this area. Councilman Wassberg attended in the Mayor’s absence.

5. NJ State League of Municipalities regarding Assembly and Senate bills that would change the PERS formula

6. Letter from a resident of Cleveland Avenue who would like a tree removed from in front of his residence.

7. Letter from Cablevision regarding a revised tariffs schedule.

8. Letter from the County of Bergen Department of Health Services Partnership for Community Health regarding the Youth Resiliency Goal Team, whose goal is to help increase awareness among all those who work with young people.

9. Certificate from Statewide Kindness Awareness Campaign awarding Hasbrouck Heights the Heart of Gold Award.

10. The NJ Emergency Management Association regarding a Proclamation for November 12-18, 2001

11. Letter from William "Pat" Schuber, County Executive, asking for a photograph of the municipality for One Bergen County Plaza.

12. State of New Jersey, Department of Community Affairs, Office of State Planning regarding proposed amendments to the State Planning Rules.

13. Letter from Leisure Club regarding the allocation for the year 2001.

14. Public Service Electric and Gas Company regarding their petition for approval of an increase in gas rates and changes in the tariffs for gas service.

15. Census 2000 profile of General Demographic Characteristics for the Borough of Hasbrouck Heights

16. Bergen County Utilities Authority Report of Audit for the Fiscal Year ended December 31, 2000.

On a motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously approved, the foregoing Communications Received were accepted to be placed on file.

 

APPROVAL OF MINUTES: (April 24, 2001 & May 8, 2001)

On a motion by Councilman Heeren, seconded by Councilman DiPisa, and unanimously carried, the foregoing Minutes were approved.

 

BILLS:

BE IT RESOLVED that the claims and accounts amounting to $1,670,051.15 specified in the schedule hereto annexed, having been examined and approved by the Finance Commissioner, or his Deputy, be paid and that warrants be issued therefor.

On a motion by Councilman Wassberg, seconded by Councilman Heeren, with Councilman Link; and Councilman Pepe voting No on Resolution No. 86, saying this was not his first choice, the foregoing Resolutions were approved. Councilman Pepe questioned Resolution No. 87 and if the cost went over $1,000 and was told this was the emergency remediation. (Copies attached)

 

APPOINTMENTS:
Christy Harrington as School Crossing Guard

On a motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried, the foregoing Appointment was accepted.

 

RESIGNATIONS:
Gerald Hackel as a Substitute School Crossing Guard

Gerard Hackel from Fire Department Engine Company Two

Mayor Torre thanked Mr. Hackel for all that he has done for the borough over the years and thanked his wife Estelle also.

On a motion by Councilman Wassberg, seconded by Councilman Pepe, and unanimously carried, the foregoing Resignation was accepted with regret.

 

RESIGNATIONS:
Nancy Marino from Design District Committee

On a motion by Councilman DiPisa, seconded by Councilwoman Verrastro, and unanimously carried, the foregoing Resignation was accepted with regret.

 

ORDINANCE (S) ON INTRODUCTION:

ORDINANCE NO. 1938:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO FIX THE SALARY AND COMPENSATION OF CERTAIN EMPLOYEES OF THE DEPARTMENT OF PUBLIC WORKS OF THE BOROUGH OF HASBROUCK HEIGHTS, NEW JERSEY, FOR THE YEAR 2001" introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on June 25, 2001.

On a motion by Councilwoman Verrastro, seconded by Councilman DiPisa, and unanimously carried, the following Ordinances on Introduction were approved.

 

ORDINANCES ON PUBLIC HEARING:

Mayor Torre opened the meeting to the public for anyone wishing to speak on Ordinances No. 1931, 1932, 1933, 1934, 1935, 1936, 1937. There being no one wishing to speak, Mayor Torre closed the public hearing on said ordinances.

ORDINANCE NO. 1931:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO AMEND AND SUPPLEMENT PARAGRAPH A GOVERNING SPECIFICATIONS OF SIDEWALKS OF SECTION 236-20 ENTITLED "SIDEWALKS AND DRIVEWAY SPECIFICATIONS" OF CHAPTER 236 ENTITLED "STREETS AND SIDEWALKS" SO AS TO PERMIT THE USE OF CERTAIN APPROVED IMPRINTED CONCRETE AND CONCRETE PAVING BLOCKS IN ADDITION TO THE MONOLITHIC CONCRETE CONSTRUCTION CURRENTLY REQUIRED IN RESPECT TO SIDEWALKS" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinances, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1932:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO AMEND AND SUPPLEMENT SECTION 236-15 ENTITLED "MAINTENANCE OF SIDEWALKS" OF CHAPTER 236 ENTITLED "STREETS AND SIDEWALKS" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO MODERNIZE ITS REFERENCES" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinances, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1933:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE PURSUANT TO N.J.S.A. 40A:12-13 AUTHORIZING THE SALE OF THE ONE-HALF UNDIVIDED INTEREST OF THE BOROUGH OF HASBROUCK HEIGHTS IN ITS 1980 AQUATECH SEWER CLEANING VEHICLE TO ITS JOINT OWNER, THE BOROUGH OF WOOD-RIDGE, IN CONSIDERATION OF THE SUM OF ONE DOLLAR" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinances, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1934:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO SUPPLEMENT ARTICLE I ENTITLED "MISCELLANEOUS OFFICES" OF CHAPTER 45 ENTITLED "OFFICERS AND EMPLOYEES OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO ESTABLISH THE OFFICE OF A LOCAL HOTEL AND MULTIPLE DWELLING INSPECTOR FOR THE PURPOSE OF ENFORCING N.J.S.A. 55:13A-1 ET SEQ., THE NEW JERSEY HOTEL AND MULTIPLE DWELLING LAW, AND THE REGULATIONS PROMULGATED THEREUNDER, ALL IN ACCORDANCE WITH THE TERMS OF THE AGREEMENT OF THIS BOROUGH WITH THE DEPARTMENT OF COMMUNITY AFFAIRS OF THE STATE OF NEW JERSEY UNDER ITS "STATE-LOCAL COOPERATIVE HOUSING INSPECTION PROGRAM"be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinances, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1935:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO APPROPRIATE THE SUM OF $450,000.00 TO PROVIDE FOR THE ACQUISITION OF A PUMPER TRUCK FOR THE USE OF THE FIRE DEPARTMENT OF THE BOROUGH OF HASBROUCK HEIGHTS AND FURTHER TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $427,500.00"be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinances, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1936:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO APPROPRIATE THE SUM OF $100,000.00 TO PROVIDE FOR THE REFURBISHMENT OF THE

HOOK AND LADDER TRUCK FOR THE USE OF THE FIRE DEPARTMENT OF THE BOROUGH OF HASBROUCK HEIGHTS AND FURTHER TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $87,000.00" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinances, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1937:

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO APPROPRIATE THE SUM OF $40,000.00 TO PROVIDE FOR THE ACQUISITION OF A SEWER LINE INSPECTION SYSTEM FOR THE USE OF THE DEPARTMENT OF PUBLIC WORKS OF THE BOROUGH OF HASBROUCK HEIGHTS AND FURTHER TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $38,000.00" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinances, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

On a motion by Councilman Pepe, seconded by Councilman Wassberg, and unanimously accepted, the foregoing Ordinances on Public Hearing were approved. During the roll call, Councilman Link had some questions regarding Ordinance No. 1936.



This being the first meeting of the month, the Mayor dispensed with opening the meeting to the public and said that the meeting would be open to the public on June 25, 2001, noting that this meeting was changed to Monday, as the Primary Election was scheduled for Tuesday, June 26, 2001.

Edwina Carroll, liaison to the Board of Education, asked to speak inviting everyone to special events to take place at Euclid and Lincoln schools, including planting of time capsules and the 4th graders of Lincoln School having their song proposed as a theme song for the State of New Jersey.

 

RECESS FOR CAUCUS:

The Mayor announced that the meeting would be recessed for Caucus.

There being no further business to be conducted by the Mayor and Council, the meeting was adjourned.
