BOROUGH OF HASBROUCK HEIGHTS

M I N U T E S

October 8, 2002


A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on October 8, 2002 at 8 p.m. at the Masonic Hall, 200 Division Avenue, corner of the Boulevard, Hasbrouck Heights, New Jersey.

In Mayor Torre’s absence, Councilman DiPisa began the meeting and stated that the meeting complied with the Sunshine Law, due notice having been made to all members by personal service on January 1, 2002 and to The Observer, The Record and the Herald News on January 1, 2002.

ROLL CALL: Present: Councilman Andrew Link III, Councilman Herbert D. Heeren, Councilman Justin A. DiPisa, Councilman Garrett R. Pepe, Councilwoman Marlene Verrastro, Councilman John Wassberg

Absent: Mayor William J. Torre

 

SALUTE TO THE FLAG AND PLEDGE OF ALLEGIANCE: Councilman DiPisa led in the Salute to the Flag and Pledge of Allegiance.

 

COMMUNICATIONS:

The following correspondence has been received as of this date:

1. Invitation to Mayor and Council to attend the Ragamuffin Parade on Saturday, October 26, at 1 p.m.

A motion to accept the Correspondence was made by Councilwoman Verrastro, seconded by Councilman Pepe, and unanimously carried.

 

PETITIONS: None

MINUTES: (August 27, 2002)

On a motion by Councilwoman Verrastro, seconded by Councilman Pepe, with the exception of Councilman Link and Councilman Heeren who abstained as they were absent on that date, the foregoing Minutes were approved.

 

 

BILLS:

BE IT RESOLVED that the claims and accounts amounting to $2,076,245.97 specified in the schedule hereto annexed, having been examined and approved by the Finance Commissioner, or his Deputy, be paid and that warrants be issued therefor.

ORDINANCE NO. 1981:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO FURTHER AMEND AND SUPPLEMENT AN ORDINANCE ENTITLED "AN ORDINANCE TO PROVIDE FOR THE SUBDIVISION OF LAND AND SITE PLAN REVIEW OF DEVELOPMENTS WITHIN THE BOROUGH OF HASBROUCK HEIGHTS PURSUANT TO THE MUNICIPAL LAND USE LAW," BEING ORDINANCE NO. 1407 ADOPTED ON MARCH 23, 1987, AS THE SAME HAS BEEN HITHERTO AMENDED AND SUPPLEMENTED, SO AS TO AMEND THE REQUIREMENTS IN RESPECT TO SIDEWALKS CONTAINED IN THE DESIGN STANDARDS FOR SUBDIVISIONS" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on October 22, 2002.

 

ORDINANCE NO. 1982:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO SUPPLEMENT CHAPTER 63 ADOPTED ON MARCH 12, 2002 AND ENTITLED "RECREATION PROGRAMS ADVISORY COMMITTEE" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SUPPLEMENTING ITS DUTIES AND AUTHORITIES, INCREASING THE MEMBERSHIP THEREOF TO FIFTEEN (15) MEMBERS, IMPOSING A TERM LIMITATION ON CERTAIN MEMBERS THEREOF AND TO PROVIDING FURTHER QUALIFICATIONS FOR MEMBERSHIP" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on October 22, 2002.

 

ORDINANCE NO. 1983:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO AMEND AND SUPPLEMENT SUBSECTION J WHICH PROHIBITS SEXUALLY ORIENTED ADULT ENTERTAINMENT AS AN ACCESSORY USE IN ALL ZONES AND WHICH IS CONTAINED IN SECTION 275-21 ENTITLED "REGULATIONS GOVERNING CERTAIN ACCESSORY STRUCTURES AND USES" OF CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS AND TO FURTHER AMEND AND SUPPLEMENT SECTION 275-20 ENTITLED  "REGULATIONS GOVERNING CERTAIN PRINCIPAL USES" OF THE SAME CHAPTER SO AS TO REPEAL SUBSECTION K THEREOF WHICH PROHIBITS AS A PRINCIPAL USE STORES FOR THE SALE OF CERTAIN PORNOGRAPHIC BOOKS AND MATERIALS AND REPLACE IT WITH A NEW SUBSECTION K THAT PROHIBITS ALL SEXUALLY ORIENTED ADULT ENTERTAINMENT AS A PRINCIPAL USE, AND TO FURTHER SUPPLEMENT BOTH OF THOSE SUBSECTIONS SO AS TO PROVIDE AN EXCEPTION ALLOWING SUCH ENTERTAINMENT IN CERTAIN SPECIFIED AREAS OF THE BOROUGH UNDER CERTAIN SPECIFIED CONDITIONS" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on October 22, 2002.

(This Ordinance was recommended by the Zoning Committee for Immediate Introduction)

On a motion by Councilwoman Verrastro, seconded by Councilman Link, and unanimously carried, except for Councilman Heeren voting No on Ordinance 1981, the foregoing Ordinances on Introduction were approved.

 

ORDINANCE(S) ON CONTINUED PUBLIC HEARING:

Councilman DiPisa opened the public hearing on Ordinance No. 1979. There being no one wishing to speak, the public hearing was continued to October 22, 2002.

 

ORDINANCE NO. 1979:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO SUPPLEMENT THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO INCLUDE THEREIN A NEW CHAPTER ENTITLED "CHAPTER 25, ENVIRONMENTAL COMMISSION," CREATING AN ENVIRONMENTAL COMMISSION IN AND FOR THE BOROUGH OF HASBROUCK HEIGHTS AND PROVIDING FOR ITS MEMBERSHIP AND POWERS" introduced on September 24, 2002 be continued on public hearing and notice of public hearing of said ordinances to be held at regular meeting of Borough Council on October 22, 2002.

On a motion by Councilman Pepe, seconded by Councilman Heeren, and unanimously carried, the foregoing Ordinance on Public Hearing was approved.

Councilman DiPisa opened the public hearing on Ordinance No. 1980. There being no one wishing to speak, the public hearing was continued to October 22, 2002.

ORDINANCE NO. 1980:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO SUPPLEMENT CHAPTER 63 ADOPTED ON MARCH 12, 2002 AND ENTITLED "RECREATION PROGRAMS ADVISORY COMMITTEE" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SUPPLEMENTING ITS DUTIES AND AUTHORITIES, INCREASING THE MEMBERSHIP THEREOF TO THIRTEEN (13) MEMBERS, IMPOSING A TERM LIMITATION ON CERTAIN MEMBERS THEREOF AND PROVIDING FURTHER QUALIFICATIONS FOR MEMBERSHIP" introduced on September 24, 2002 be continued on public hearing and notice of public hearing of said ordinances to be held at regular meeting of Borough Council on October 22, 2002.

On a motion by Councilman Pepe, seconded by Councilman Heeren, and unanimously carried, the foregoing Ordinance was Continued on Public Hearing.

 

MISCELLANEOUS FROM PUBLIC:

Councilman DiPisa opened the meeting up to the public as per the Open Public Meetings Act legislation which was signed into law recently which requires that there be an opportunity for public comment at every meeting.

Councilman DiPisa began this portion of the meeting by noting that an open forum had been held with the business community including the Chamber of Commerce, the Council and the Planning Board, including Assemblywoman Rose Heck, to discuss issues important to the business district. A Boulevard Business Advisory Committee was appointed by Mayor Torre and includes Mary Ellen Courtney, Thomas Meli, Councilman DiPisa, George Eggers and Michael Kronyak.

Gerry McGill, 139 Field Avenue, questioned the borough engineer regarding flooding of Field Avenue, if a lagoon could be created to accept the run off from heavy rainwater and was told by the borough engineer that this was not possible. The only solution would be to clean the Riser Ditch which requires all the towns along its perimeters to get involved. Assemblywoman Heck was currently working on this project and a regional commission was proposed.

Ann McGill, 139 Field Avenue, regarding Ordinance No. 1983 which was on introduction asked for it to be explained in laymen terms and was told it must first be published, which was hoped to be this week, and she was advised to read it and if she had any questions, she could call the borough attorney.

 

RECESS FOR CAUCUS

Councilman DiPisa announced that the meeting would be recessed for Caucus.

There being no further business to be conducted by the Mayor and Council, the meeting was adjourned.
