BOROUGH OF HASBROUCK HEIGHTS

M I N U T E S

November 12, 2002

A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on November 12, 2002 at 8 p.m. at the Masonic Hall, 200 Division Avenue, corner of the Boulevard, Hasbrouck Heights, New Jersey.

Mayor Torre began the meeting and stated that the meeting complied with the Sunshine Law, due notice having been made to all members by personal service on January 1, 2002 and to The Observer, The Record and the Herald News on January 1, 2002.

ROLL CALL: Present: Mayor William J. Torre, Councilman Andrew Link III, Councilman Herbert D. Heeren, Councilman Justin A. DiPisa, Councilman Garrett R. Pepe, Councilwoman Marlene Verrastro,

Absent: Councilman John Wassberg

 

SALUTE TO THE FLAG AND PLEDGE OF ALLEGIANCE: Mayor Torre led in the Salute to the Flag and Pledge of Allegiance.

 

PRESENTATION:

A donation to the Hasbrouck Heights Food Bank was made by Primerica, an organization that has three regional offices in the Borough, which was collected when they learned that there were limited supplies available. Councilman Heeren and Social Services Director Lee Kulakowski assisted Mayor Torre in accepting the donation. Representatives from Primerica included William Terrazzi, Dr. Sam Von Reiche and Tommy Lee.

 

COMMUNICATIONS:

PETITIONS: Field Avenue Sanitary Sewer Line

A copy of a petition was submitted by residents of Field Avenue (copy attached). This petition was a copy and the original would be referred to the borough attorney and engineer when received.

On a motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried, the foregoing Petition was accepted.

 

 

MINUTES: (September 24, 2002, October 8, 2002 and October 15, 2002)

On a motion by Councilman DiPisa, seconded by Councilwoman Verrastro, and unanimously carried, the foregoing Minutes were approved.

 

BILLS:

BE IT RESOLVED that the claims and accounts amounting to $2,737,954.26 specified in the schedule hereto annexed, having been examined and approved by the Finance Commissioner, or his Deputy, be paid and that warrants be issued therefor.

On a motion by Councilman Heeren, seconded by Councilwoman Verrastro, and unanimously carried, the foregoing Resolutions were approved. (Copies attached.)

 

APPOINTMENTS: None

RESIGNATIONS: Rita Ratkowski as a Crossing Guard

On a motion by Councilman Pepe, seconded by Councilwoman Verrastro, and unanimously carried, the foregoing Resignation was accepted with regret.

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO FURTHER SUPPLEMENT CHAPTER 271 ENTITLED "TOWING OF VEHICLES" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO AMEND THE MANNER IN WHICH THE ANNUAL LIST OF APPROVED TOWERS IS COMPOSED IN ORDER TO ELIMINATE ANY INEQUITY THAT MAY RESULT FROM THE REQUIREMENT THAT SUCH LIST BE COMPOSED IN ALPHABETICAL ORDER" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on November 26, 2002.

 

ORDINANCE NO. 1986:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO SUPPLEMENT CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO EXPRESSLY PROVIDE THEREIN A PROHIBITION AGAINST CERTAIN USES" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on November 26, 2002.

 

ORDINANCE NO. 1987:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO FIX THE SALARY AND COMPENSATION OF CERTAIN OF THE OFFICERS AND EMPLOYEES OF THE BOROUGH OF HASBROUCK HEIGHTS, NEW JERSEY, FOR THE YEAR 2002" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on November 26, 2002.

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO APPROPRIATE THE SUM OF $200,000.00 TO PROVIDE FOR THE ACQUISITION OF A GARBAGE TRUCK AND DUMP TRUCK FOR THE USE OF THE DEPARTMENT OF PUBLIC WORKS OF THE BOROUGH OF HASBROUCK HEIGHTS AND FURTHER TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $190,000.00" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on November 26, 2002.

 

ORDINANCE NO. 1990:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO APPROPRIATE THE SUM OF $25,000.00 TO PROVIDE FOR THE ACQUISITION OF GEAR AND EQUIPMENT FOR THE USE OF THE FIRE DEPARTMENT OF THE BOROUGH OF HASBROUCK HEIGHTS AND FURTHER TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $13,750.00" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on November 26, 2002.

 

ORDINANCE NO. 1991:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO APPROPRIATE THE SUM OF $50,000.00 TO PROVIDE FOR THE RECONSTRUCTION OF CERTAIN

SANITARY SEWERAGE FACILITIES IN THE BOROUGH OF HASBROUCK HEIGHTS AND FURTHER TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $47,500.00" was introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on November 26, 2002.

 

ORDINANCE NO. 1981:

Mayor Torre opened the public hearing on Ordinance No. 1981. There being no one wishing to speak, the public hearing was closed.

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE TO FURTHER AMEND AND SUPPLEMENT AN ORDINANCE ENTITLED "AN ORDINANCE TO PROVIDE FOR THE SUBDIVISION OF LAND AND SITE PLAN REVIEW OF DEVELOPMENTS WITHIN THE BOROUGH OF HASBROUCK HEIGHTS PURSUANT TO THE MUNICIPAL LAND USE LAW," BEING ORDINANCE NO. 1407 ADOPTED ON MARCH 23, 1987, AS THE SAME HAS BEEN HITHERTO AMENDED AND SUPPLEMENTED, SO AS TO AMEND THE REQUIREMENTS IN RESPECT TO SIDEWALKS CONTAINED IN THE DESIGN STANDARDS FOR SUBDIVISIONS" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

On a motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried, except for Councilman Heeren voting Nay on Ordinance 1981, the foregoing Ordinance on Public Hearing was approved. Councilman Heeren noted his reasoning was that if someone applies for a subdivision and there is a question on sidewalks, it should be part of the Planning Board decision. Mayor Torre noted that the councilman made a good point, but the purpose of this ordinance was to preserve the rural character of certain neighborhoods of the Borough, example given of Wood Street where there are no sidewalks.

 

ORDINANCE NO. 1983:

Mayor Torre opened the public hearing on Ordinance No. 1983. There being no one wishing to speak, the public hearing was continued to November 26, 2002 on this ordinance as a recommendation had not been received from the Planning Board.

BE IT RESOLVED that an Ordinance entitled ""AN ORDINANCE TO AMEND AND SUPPLEMENT SUBSECTION J WHICH PROHIBITS SEXUALLY ORIENTED ADULT ENTERTAINMENT AS AN ACCESSORY USE IN ALL ZONES AND WHICH IS CONTAINED IN SECTION 275-21 ENTITLED "REGULATIONS GOVERNING CERTAIN ACCESSORY STRUCTURES AND USES" OF CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS AND TO FURTHER AMEND AND SUPPLEMENT SECTION 275-20 ENTITLED

"REGULATIONS GOVERNING CERTAIN PRINCIPAL USES" OF THE SAME CHAPTER SO AS TO REPEAL SUBSECTION K THEREOF WHICH PROHIBITS AS A PRINCIPAL USE STORES FOR THE SALE OF CERTAIN PORNOGRAPHIC BOOKS AND MATERIALS AND REPLACE IT WITH A NEW SUBSECTION K THAT PROHIBITS ALL SEXUALLY ORIENTED ADULT ENTERTAINMENT AS A PRINCIPAL USE, AND TO FURTHER SUPPLEMENT BOTH OF THOSE SUBSECTIONS SO AS TO PROVIDE AN EXCEPTION ALLOWING SUCH ENTERTAINMENT IN CERTAIN SPECIFIED AREAS OF THE BOROUGH UNDER CERTAIN SPECIFIED CONDITIONS" introduced on October 8, 2002 was continued on public hearing.

On a motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried, the foregoing Ordinance on Public Hearing was continued.

 

MISCELLANEOUS FROM PUBLIC:

Mayor Torre opened the meeting up to the public as per the Open Public Meetings Act legislation which was signed into law recently which requires that there be an opportunity for public comment at every meeting.

Ron Ellis, 107 Paterson Avenue, presented information and requested that a permanent bus stop be located at Paterson Avenue giving reasons why he was making this request. It was now a courteous stop and not always adhered to by the bus drivers. He passed out diagrams supporting his request. Mayor Torre advised that he meet with Streets Commissioner Heeren, Deputy Streets Commissioner Verrastro, Chief Colaneri and Sgt. Archer. Mayor Torre recalled that a bus stop required 125 feet of curb which should be considered in his request. Police Chief Colaneri was asked to make his recommendations. It was also recommended that the La Salle Avenue bus stop which was dangerous to the school children be looked at also.

 

RECESS FOR CAUCUS:

Mayor Torre announced that the meeting would be recessed for Caucus.

There being no further business to be conducted by the Mayor and Council, the meeting was adjourned.
